Terms and Conditions for the Provision of Services at US Clinic
Dear Customers!
In the interests of your safety and health, as well as that of our staff, and in order to continuously improve the quality of the services we provide, please familiarise yourself with the terms and conditions governing the provision of beauty treatments at our salon before using our services.
§ 1 General Provisions
- These terms and conditions, hereinafter referred to as the “Terms and Conditions”, set out the rules for using the services provided at US Clinic.
- US Clinic clients are required to familiarise themselves with the Terms and Conditions before undergoing any treatment.
- Undergoing a Treatment is tantamount to accepting the provisions of the Terms and Conditions. Every Customer is obliged to comply strictly with its provisions from the moment they undergo a Treatment.
- These Terms and Conditions do not constitute terms and conditions for the provision of electronic services within the meaning of the Act on the Provision of Electronic Services and apply exclusively to services provided at physical premises.
§ 2 Opening hours
- US Clinic provides services at 25/1a Mieszczańska Street in Wrocław, from Monday to Friday between 9.00 am and 8.00 pm, and on Saturdays between 10.00 am and 3.00 pm. US Clinic is closed on public holidays and Sundays.
- Opening hours may be subject to change for reasons beyond our control, such as staff absence or unforeseen circumstances (e.g. power, water or gas cuts).
§ 3 Clients
- Any adult natural person may be a client of US Clinic.
- Minors under the age of 18 may undergo Treatments with the express consent of their parent, guardian or legal representative. A Clinic employee is entitled at any time to request the presentation of the relevant consent or to contact the person authorised to give it in order to confirm consent, and to refuse to provide the Treatment in the event of a lack of consent or a refusal to give it.
- In the interests of safety, the comfort of other Clients and the proper conduct of Treatments, accompanying persons, including children, are not permitted in the treatment rooms unless US Clinic staff have given their prior consent. The Client bears full responsibility for the behaviour of any accompanying persons they bring onto the premises of US Clinic, including for any material or non-material damage caused by such persons to US Clinic, its staff, other Clients or property located on the Clinic’s premises. US Clinic accepts no liability for the safety of accompanying persons or for any harm they may suffer whilst on the Clinic’s premises.
- In the event that damage is caused by an accompanying person, the Customer undertakes to cover all costs associated with rectifying the damage, including the costs of repairing or replacing damaged property and any claims by third parties.
- US Clinic reserves the right to refuse to provide services and to block the ability to make bookings for any Client who engages in verbal or physical aggression, makes threats, infringe upon the personal rights of staff or other Clients, or publish false information that damages the reputation of US Clinic.
§ 4 Staff
- Staff are suitably trained for their respective roles and hold all the necessary certificates, qualifications and authorisations to work in a capacity appropriate to their position.
- Before commencing a Treatment, an employee is obliged to check the condition of their workstation and ensure they have a supply of disposable and protective materials, as well as sterilised instruments.
- Before commencing a Procedure, an employee is required to disinfect their workstation, their hands and forearms up to the elbows, and reusable instruments. The employee must carry out the same procedures during the procedure if they interrupt its continuity, and after the procedure has been completed.
- Staff are required to keep their hands and nails in such a condition as to minimise the risk of scratches and cuts.
- Staff are required to tie back their hair to minimise the risk of it entering the treatment area.
- Salon staff are required to comply with health and safety and fire safety regulations.
- Clients should immediately report any breaches of the above rules to the owner, manager or another member of the Salon’s staff who is on duty at the time.
§ 5 Hygiene and safety
- Flat surfaces and other items of US Clinic equipment with which the Client has no direct contact during the Treatment are disinfected or sterilised at least once a day.
- US Clinic staff with open wounds, cuts or oozing skin lesions that cannot be adequately protected from contact with the Client’s body are suspended from providing services until such conditions have been fully resolved.
- In the event that a Client is injured during the Treatment, the Treatment is immediately halted, and the site of the injury is promptly washed, disinfected and covered with a sterile dressing appropriate to the severity of the injury. The interrupted treatment is completed at a time convenient for the Client, at no extra charge, following prior arrangement of a date and only once the injury has fully healed.
- At US Clinic, only disinfectants authorised for use in beauty salons are used.
§ 6 Bookings
- The client may book an appointment for a treatment at US Clinic in advance, by telephone, email or via the Booksy app.
- Please plan your visit in detail, i.e. the main treatment and any accompanying minor services such as: upper lip hair removal, henna eyebrow shaping, underarm hair removal and others. We will be happy to accommodate all requests provided we have sufficient time so that the next client does not have to wait.
- When booking a treatment, US Clinic may require a non-refundable deposit of up to 50% of the service cost, payable by bank transfer or Blik, at least 24 hours before the scheduled appointment; otherwise, the booking will be cancelled.
- Failure to attend the treatment at the agreed time or cancelling the appointment less than 24 hours before it is due to start entitles US Clinic to refuse to make further bookings for that Customer or to charge them a non-refundable deposit of up to 50 per cent of the treatment price for the next treatment. Furthermore, US Clinic, in the event that the Customer cancels the agreed appointment with less than than 24 hours, US Clinic is entitled to require a prepayment (deposit) of up to 50 per cent of the value of the Treatment in question prior to the next scheduled appointment; however, if the Client has purchased a package, there is no need to charge a prepayment, but if the Customer fails to attend a scheduled (and not cancelled within the required time) appointment, US Clinic is entitled to count the treatment from the package as ‘completed’.
- Any non-refundable deposit paid will be credited towards the cost of the Treatment. If the Client cancels the appointment less than 24 hours before the scheduled time or fails to attend the appointment, the deposit will be forfeited to US Clinic to cover organisational costs and the cost of booking the appointment.
- If an appointment is rescheduled at least 24 hours before the scheduled treatment, the deposit paid will be carried over to the new date; in such cases, the appointment may be rescheduled once.
- Clients must arrive for their booked Treatments no later than 5 minutes before the agreed time. US Clinic reserves the right not to carry out the Treatment for a Client who arrives more than 10 minutes late.
- Notwithstanding the above, with the Client’s express consent, the Treatment may be carried out even if the Client is late, provided that the individual stages of the Treatment are shortened at the Employee’s discretion, with the exception of stages which have a specified minimum duration. The full price is payable for a Treatment carried out in this manner.
- In the event of a delay to the Treatment for reasons attributable to the Salon, including the Employee, none of the stages will be shortened.
- US Clinic reserves the right to cancel a Treatment appointment 24 hours prior to the scheduled time; in such cases, a new appointment time will be agreed with the Customer.
- Priority for treatment appointments is given to Clients who have made a booking.
§ 7 Provision of cosmetic, cosmetological and medical services
- Before commencing the Treatment, the Staff Member will conduct a consultation and assessment with the Client to determine whether the Client’s state of health, past or present medical conditions, any medication they are taking, treatments they are undergoing or their lifestyle do not constitute contraindications to the Treatment or pose an increased risk of adverse effects, and to provide pre- and post-treatment recommendations.
- Before the Treatment is carried out, each Client is informed of its nature, indications, contraindications, possible side effects, the risk of complications and post-treatment recommendations. Proceeding with the Treatment implies that the Client has read, understood and accepted the above information. For certain Treatments, a Staff Member may require the Client to provide an appropriate written statement or consent.
- The Client is obliged to provide full, truthful and up-to-date information regarding their state of health and to inform the Staff Member immediately of any circumstances that may affect the safety or course of the Treatment, in particular:
a) chronic diseases, autoimmune, dermatological and oncological conditions,
b) heart conditions, the presence of a pacemaker or other implants,
c) inflammation, infections, fever or other infectious diseases,
d) pregnancy, the postnatal period or breastfeeding,
e) any implants, prostheses, inlays or foreign bodies,
f) taking medication, in particular anticoagulants, steroids, retinoids, antibiotics or photosensitising drugs,
g) allergies, hypersensitivities, a tendency to keloid scarring, fainting spells or unusual bodily reactions. - In the event of subsequent Treatments, the Client is obliged to confirm the validity of the information provided on each occasion and to report any changes in their state of health, medication taken or other circumstances that may affect the safety of the Treatment.
- The Client is obliged to remove all jewellery before the Treatment and to secure any valuables in their possession. US Clinic accepts no liability for items left unattended.
- The Client is obliged to inform a Member of Staff immediately of any deterioration in their well-being, any discomfort felt or the occurrence of any worrying symptoms whilst the Treatment is being carried out.
- A staff member has the right to refuse to carry out the Treatment or to interrupt it if:
a) there are medical contraindications to carrying out the Treatment,
b) carrying out the Treatment could pose a threat to the Client’s health or life,
c) the Client refuses to provide the information necessary for eligibility for the Treatment, or the information provided raises reasonable doubts,
d) the Client is under the influence of alcohol, narcotics or psychoactive substances;
e) the Client’s behaviour is aggressive, offensive or breaches the rules of social conduct, or jeopardises the safety of staff or other Clients;
f) the Client fails to follow the staff’s instructions or refuses to comply with the procedures in force at US Clinic;
g) there is reasonable suspicion that the Client’s actions may be intended to constitute fraud, the fraudulent obtaining of a service or an unlawful act. - US Clinic staff have the right to refuse to carry out the Treatment without providing a detailed justification if they consider that carrying out the Treatment could breach safety rules, ethical standards or the interests of US Clinic.
- Should the Client withhold information regarding their state of health, medication taken, past illnesses or other circumstances that may constitute a contraindication to the Treatment, the Client shall bear full responsibility for the resulting consequences, including the occurrence of adverse reactions, complications or the need to discontinue treatment.
- US Clinic accepts no liability for the consequences of the Client’s failure to comply with pre- and post-treatment recommendations, nor for the Client providing incomplete, out-of-date or false information regarding their state of health.
- The final decision on the Client’s eligibility for the Treatment rests solely with US Clinic staff. Staff have the right to refuse to carry out the Treatment or to alter the scope of the planned Treatment, even immediately prior to its commencement, should new circumstances, information or concerns regarding the safety of the procedure come to light.
- Refusal to carry out the Treatment for the reasons set out in these Terms and Conditions, in particular due to medical contraindications, the inability to carry out the Treatment safely, the Client’s withholding of information, or failure to meet the eligibility requirements, does not constitute a breach or improper performance of the contract by US Clinic and cannot form the basis for any claims against US Clinic.
- Should contraindications to the performance of the Treatment be identified, US Clinic staff may propose to the Client a change to the date of the Treatment, a change to the type of Treatment, or an additional specialist consultation.
- The Client acknowledges that the results of cosmetic and aesthetic treatments depend on the individual’s physiological predisposition, compliance with staff recommendations, state of health and factors beyond US Clinic’s control; consequently, US Clinic does not guarantee the achievement of a specific aesthetic result.
- Should any worrying symptoms or adverse effects occur following the Treatment, the Client is obliged to contact US Clinic immediately and to follow the advice provided.
- The Client declares that all information provided during the consultation and assessment for the Treatment is complete, truthful and up to date, and undertakes to inform US Clinic immediately of any change in their state of health that may affect the feasibility or safety of the Treatment.
- Attending a consultation, booking an appointment or paying a deposit does not automatically constitute eligibility for the Procedure. The final decision on whether the Procedure can be carried out is made on a case-by-case basis immediately prior to its commencement.
§ 8 Payment
- The Client is obliged to pay for the services provided. The price list for Treatments is available online at: www.usclinic.pl/cennik/.
- US Clinic offers the following payment methods: cash at the till, payment by card at the terminal, or BLIK payment.
- US Clinic reserves the right to run temporary promotions on the Treatments it provides. Taking advantage of a reduced price or a promotional offer may be subject to separate terms and conditions, which will be made public. Customers who have paid the full price for a treatment are not entitled to any claims in respect of promotions. Promotions and discounts cannot be combined.
- Terms and conditions for the use of promotional vouchers:A) Vouchers with a face value of PLN 50 and PLN 100, issued by the Clinic as part of promotional campaigns, events or charitable initiatives, constitute a one-off discount granted by the Clinic and are not purchased vouchers.B) The vouchers referred to in sub-point ‘A)’ cannot be combined with other vouchers, discounts, promotions or special offers.C) Each voucher may only be used during a single visit and for a single selected treatment, in accordance with the current price list.D) The Clinic reserves the right to refuse to honour a voucher in the event of a breach of the rules set out in this paragraph.
- US Clinic also offers vouchers, payable in advance, entitling the holder to a specified number of treatments within a specified period. Vouchers purchased in person at US Clinic or via the website www.usclinic.pl are valid for cosmetology treatments only; they do not apply to aesthetic medicine treatments.
- US Clinic reserves the right to change the prices of services, treatment descriptions and the manner in which they are performed. The current price list and the applicable rules governing the provision of services are made available each time prior to the treatment being carried out. A price change does not affect treatments that have already been paid for or booked on the basis of a previously valid offer, unless the customer agrees to a different method of service provision.
§ 9 Liability
- Clients are fully liable for any damage to US Clinic’s equipment. In the case of damage caused by minors, their legal representatives shall be liable.
- US Clinic is liable for outerwear entrusted to it for safekeeping, provided there is a designated area for leaving such items, or for other items if they have been expressly accepted for safekeeping. However, US Clinic shall not be liable for any items left inside outerwear or within the Clinic outside the designated storage areas, in particular valuables, bags, rucksacks and handbags, which the Customer should keep with them at all times.
- Failure by the Client to comply with the provisions of these Terms and Conditions, or making false statements regarding their state of health and contraindications, or during the consultation, shall result in US Clinic being exempt from liability for the Treatment performed.
- US Clinic shall not be liable for the Client’s dissatisfaction with the final result of the Treatment, arising from the Client’s subjective feelings, provided that the Treatment was carried out professionally, in accordance with cosmetic best practice and in a manner that meets generally accepted standards.
- Information on medical services and training courses relates to the activities of independent entities cooperating with US Clinic on a premises-let basis.
- US Clinic makes treatment rooms available exclusively on a lease basis to entities conducting their own independent business activities or professional practice.
- The entities renting the treatment rooms carry out all medical and aesthetic procedures and conduct training courses in their own name, at their own expense and on their own responsibility, bearing full civil, professional and legal liability towards patients and training participants.
- US Clinic is not a party to any contracts concluded between the tenant and a patient or training participant and accepts no liability for the conduct, outcomes, quality, safety or regulatory compliance of the procedures performed, nor for the suitability of patients or the acts or omissions of the tenant and their staff.
- Administrative support, including the management of bookings by the US Clinic reception, is of a purely technical and organisational nature; it does not constitute intermediation in the provision of medical or training services and does not affect the scope of US Clinic’s liability, which remains excluded.
- The Lessor bears sole responsibility for holding the licences, authorisations and third-party liability insurance required by law, for maintaining medical records, and for complying with applicable legal provisions, including those relating to medical practice and the protection of personal data.
- Information regarding medical services and training courses provided in the leased premises relates to the activities of independent entities cooperating with US Clinic solely on the basis of a lease of premises.
§ 10 Complaints
- The client has the right to lodge a complaint regarding the manner in which a Treatment was performed or its results, within 5 working days of the Treatment being carried out or the occurrence of any adverse effects of the Treatment. To lodge a complaint, it is necessary to provide proof, in any form, that the Treatment was performed at US Clinic.
- Complaints must be submitted in writing, either in person at US Clinic or by registered post sent to US Clinic’s address. It is advisable to attach photographic evidence to the complaint.
- All complaints will be considered within 14 days.
- If the complaint is upheld, US Clinic will refund the cost of the Treatment to the Customer or allow them to undergo a corrective Treatment free of charge, to be carried out by a supervisor of the Staff Member who performed the original Treatment.
- If the complaint is rejected, the Customer has the right to appeal against this decision within 14 days. In the appeal proceedings, the above provisions shall apply mutatis mutandis.
- If the Treatment is disputed immediately after it has been carried out, the Customer is not exempt from paying for the service provided – should their claims be valid, any refund will be made in full. However, US Clinic reserves the right to waive the fee for the Customer where there are clearly valid grounds for the complaint.
- US Clinic advises that the results of Treatments may vary between Clients, depending on individual physiological characteristics. Natural reactions such as redness, swelling, tenderness, bruising or irritation do not constitute grounds for a complaint.
- The Customer bears full responsibility for any consequences arising from the withholding of information regarding their state of health, medication taken, past illnesses, previous treatments or other contraindications.
- Failure to follow post-treatment instructions may lead to complications and a loss of results. In such cases, the Client forfeits the right to make a complaint.
A complaint may relate solely to the manner in which the service was performed or to any failure to comply with accepted standards. A complaint may not be based solely on the Client’s subjective dissatisfaction with the aesthetic result achieved, provided the Client has been previously informed of the possible outcomes of the Treatment and the risk of an individual bodily reaction.
- For the purpose of documenting the course of treatment and assessing the results of the Treatments, US Clinic may take photographs of the treatment area, but only after obtaining the Client’s separate consent and in accordance with the applicable data protection regulations.
- The Client undertakes to follow all pre- and post-treatment recommendations provided by US Clinic staff. Failure to comply with these recommendations may affect the safety of the Treatment, the healing process and the final outcome of the therapy.
- US Clinic accepts no liability for claims arising from the activities of entities letting treatment rooms, in particular for the medical, organisational, financial or legal consequences of the services they provide.
§ 11 Miscellaneous provisions
- Smoking and the use of tobacco, tobacco products and nicotine products, including e-cigarettes, are strictly prohibited throughout the US Clinic premises; furthermore, the consumption of alcoholic beverages and other types of stimulants and intoxicating substances is strictly prohibited.
- Animals are not permitted on the premises of the Clinic.
- Please do not bring small children to your appointment, as they may disturb the peace and relaxation of other clients and the concentration of our beauticians and doctors. US Clinic contains equipment and substances that are hazardous to children. We accept no liability for children left unattended in the clinic.
§ 12 Final provisions
- Every client has the right to inspect the terms and conditions, price list and certificates referred to by US Clinic or its staff.
- US Clinic reserves the right to amend these terms and conditions. New provisions shall be binding from the moment they are published by US Clinic. The previous provisions shall apply to bookings and treatments carried out prior to any such changes.
- Any disputes arising from the services provided should, in the first instance, be resolved amicably.
- These Terms and Conditions come into force on 21 January 2023.
